Well,I have done it! I have read the entire text of proposed House Bill 3200:The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise,constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.
To begin with,much of what has been said about the law and its implications is in fact true,despite what the Democrats and the media are saying. The law does provide for rationing of health care,particularly where senior citizens and other classes of citizens are involved,free health care for illegal immigrants,free abortion services,and probably forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions,payments to physicians,and allocations of necessary medical devices will be strictly controlled.
However,as scary as all of that is,it just scratches the surface. In fact,I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred,or even been contemplated. If this law or a similar one is adopted,major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go will be the masterfully crafted balance of power between the Executive,Legislative,and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.
This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information,your personal financial information,and the information of your employer,physician,and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.
If you decide not to have healthcare insurance or if you have private insurance that is not deemed “acceptable” to the “Health Choices Administrator” appointed by Obama there will be a tax imposed on you. It is called a “tax” instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However,that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax,it is definitely depriving someone of property without the �due process of law.
So,there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law. It doesn’t stop there though. The 9th Amendment that provides:“The enumeration in the Constitution,of certain rights,shall not be construed to deny or disparage others retained by the people;” The 10th Amendment states:“The powers not delegated to the United States by the Constitution,nor prohibited by it to the States,are preserved to the States respectively,or to the people.” Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation,but I think you get the idea. This is not about health care;it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to ‘be bound by oath or affirmation’ to support the Constitution. If I was a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway I would hope the American people would hold me accountable.

I've read a good bit of the bill and most of what I saw was very,very BAD! The cost alone is outrageous. And it's going to create numerous new bureaucracies which translates to hundreds/thousands of new government jobs at the taxpayers expense. Not to mention the 'subsidies'. I just heard a report on CNN stating that people making up to eighty thou a year will be subsidized. And we all know where those 'subsidies'will come from. Loosen those purse strings America!
Today the federal government is 'mandating'we buy health insurance. Is a life insurance mandate next? And after that what might they go after? Where will it end? Any ideas? Anyone?
I believe it will end with a REVOLUTION and the ABOLISHMENT of this current government which we have a right to do under the Constitution. I think we need to do this ASAP and that will give each State the power to run its own business. Then we rebuild in Nov. with new people from top to bottom. I also think in order to be President you must be a Governor and run a State efficiently to prove you can run a Nation. Recent reports show Obama DOES NOT AND NEVER DID HAVE A LAW LICENSE! Big surprise! What I think is next with the "preventive"measures for health in this Bill will be you cannot eat what you want or smoke or whatever. These Supreme Court justices need to be praised for one,for upholding the stance on "One Nation Under God",but also need to reexamine the case that forced prayer out of schools. There were a couple kids who got into trouble at a middle school in CA for praying,so it's not just illegal to have prayer meetings in a public institution,it is apparently unlawful! If you're an expert in Constitutional Law,then please tell us what we can do! E.g.:Is it possible for each State to gather signatures to put a Referendum on each State's ballot in November to repeal this no matter who is elected in Nov? Isn't that possible? Isn't it a 2/3 majority of States? Please advise.
Also –was it or was it not a violation of our Constitution for the House to pass the Bill WITH changes? I thought that once the House and Senat's Bills were not in agreement,the only way for this Bill to pass,at this point,was to Pass it without changes. But,the House passed it WITH changes. Isn't this a violation of how we pass laws? This Bill should have been deemed dead. But,the House made back-door agreements and took promises of changes to it in the future. So,how can this be passed in the first place when our precedents have already been in place as to how we pass things into law. Please lend your thoughts regarding what WE CAN DO –so that we get the wheels in motion without delay. Thank you!

This is what I am sending out to friends and family. I am like the rest of you. I am a father but I am willing to do whatever necessary to perserve our way of life for this great country. I would give my life in the blink of an eye because that is what Americans do. We are not like socialist and communist who are forced to war by dictators. When our freedom and safety of our nation hangs in the balance,we step up and give blood,sweat and tears. That is why this country is the greatest country in the world.
Yeah…with the passing of this health care,the school loans tied in with it,and the take over of banks and the auto industry,I guess,I just decided to look and see if any petitions for impeachment that seemed legit were going around. I found this one. I am planning on looking into how to contact Gov. Daniels's and Attorney General Zoeler's offices. If everyone sits on their hands and does nothing,then we can not complain for allowing our country to be transformed into a socialist state. Personally,our country has drifted far enough off path with subtle freedoms gradually being taken away. Right now,the change he promised is happening. It is the kind of change that is catastrophic and disgusts me that it is happening. We are watching the beginning of the end of the United States and it's now happening in leaps and bounds,no more subtle or gradual changes. As concerned as I am about House Bill 3200,I am more concerned about Obama's birth certificate and his having the required status to get his name on a ballot. The language about "birth in the US"seems clear enough. What I wonder about is,as written,who has the obligation to attest to the facts –and,if incorrect,take whatever steps are needed to keep someone unqualified OFF the ballot. Our founders did not leave a lot of "loose ends"in their preparation of the Constitution. Who did THEY think was going to "guard the portals",so we would not find ourselves with "a pretender"!

Sadly I think we failed to see what our country was becoming. We were too trusting or complacent. I feel the frustration that all of you are feeling ,I am extremely concerned about our future also. I believe this administraion would love nothing better than the citizens to be taking up arms right now. Then they could label us as the loones from the right and crackdown even harder on their suppression. If we react prematurely,we would be playing into their scheme. We have got to get more people into office that believe in the values that shaped this great nation. This will take alot of time and effort on our parts. We need to keep protesting publicly and peacefully. The rest of America is waking up from their stupor,slowly,but there is some movement. Our fellow citizens need to see that we are not some right wing fringe group. They need to see that we are not going away and that our message is a cry for freedom and justice for all. I agree with all that is said in these posts. However what I do not see are concrete steps to the path of removal for this evil that is called obama. What steps are necessary to begin the process of taking back our country. You can't just run out in the street and start shooting. You have to have a plan of action and someone to coordinate your efforts. Put something in here that people can actually do to get the ball rolling. Someone to contact to focus our efforts. In a nutshell –I think we should boycott the federal government –shut it down. Then impeach Obama,Pelosi,Reid and every other liberal democrat who voted for the health care bill atrocity. Replace all these leftist bastards with men &women with strong ethical values and moral fiber and who are loyal,constitutionalists whether Republican or independent . I'm all for just one party –"The People's Party",of the people,by the people. Next I'd like to see every unconstitutional law on the books repealed and the wings of the federal gov't clipped,reducing it to the size allowed it by the constitution. That done,America would be back on track with what our founding father's intended. I'd like to see every illegal alien deported. Then there would be enough jobs for every American. There is enough wealth in this country to eliminate poverty –enough industry and business to put everyone to work. And enough military power to keep out illegals and terrorists. I suggest that everyone tune into the Glenn Beck show @ 5:00 pm Fox News station,he tells it like it is and has good common sense advice about what our next moves should be,catch his program while you still can. ( I don't expect the president and his czars to let Glenn inform America about the truth much longer.) Also get in touch with some of the Tea Party groups around the country. I believe there is a Tea Party Express III on the road right now,heading to Washington DC,due to arrive by April 15 th.. Just get involved where you can,speak to your friends and neighbors about your concerns,the more people that hear our message the better,don't let the Socialists silence or divide us,and get on your knees and pray that the Lord will give you strength and wisdom to overcome what lies ahead. Have you actually read what is in the bill or are you taking the words from the mouths of sycophants and snakes?
I am so sick of it all. I have wrote to my congressmen and representatives on how i feel. But is it too little too late? I feel we need to spread the word more that this is what they claim to of given us but this is all they took. Are we going to just stand and take it?
I hear people complain about it yet no one wants to say anything for fear of our government. Which was never supposed to be this way. Don't believe me go read the history,
Our 'representational government'has been eroding since WW2…and many far more savvy politically than I simply say this is a classic power grab,the Demos are at bat…but not for long. The two party system needs revision with a viable third party emerging. I think Third Party has a nice ring to it,and it sounds like enough folks are now shocked enough to shut off the boob-tube and get it started (Tea Party is another slick name). The sad fact seems to be that elected officials felt sufficiently insulated by position and 'institution'to have actually supported this swill. Their collective failure,ejecting all incubents like a spent cartridge,would be a great platform for launching a third party. Take aim at big government—they've been targeting you and yours for decades. Three cheers for the third party,go forth and roast,tar and feather vested interest (and every other attorney too) wherever and whenever it rears its malignant little head.
